AI Governance in India: What Compliance Actually Requires Right Now

Compliance conversations around AI are often dominated by speculation about future regulation. But the compliance obligations for Indian businesses building or deploying AI right now are more concrete than the debate suggests. Between India’s Digital Personal Data Protection Act, sector-specific guidance from financial regulators, and the EU AI Act’s indirect reach through export-facing services, many Indian enterprises already have real obligations, even without a comprehensive national AI law.

The DPDP Act and What It Means for AI

The Digital Personal Data Protection Act 2023 was passed by Parliament but its detailed implementing rules were still being finalized by MeitY as of late 2025. That uncertainty is itself a compliance risk. Organizations that wait for the final rules to start preparing are likely to find themselves short of time once the rules are notified.

The principles the Act establishes are clear even without the rules:

  • Consent and purpose limitation: Personal data may only be processed for the purpose for which consent was given. If you’re training an AI model on customer data or running AI features that process personal information, the consent basis needs to be explicit and documented.
  • Data minimization: AI systems should not collect or retain more personal data than the task requires. Many AI integrations, particularly those that log queries and responses for model improvement, need to be reviewed against this principle.
  • Data fiduciary obligations: Organizations that determine the purpose and means of processing personal data bear accountability for how that data flows through third-party AI providers.

For companies using third-party AI APIs (OpenAI, Google, Anthropic, etc.) to process Indian users’ personal data, the data transfer and sub-processor question is one that legal and technical teams need to work through together.

Sector-Specific Regulation Is Already Active

India’s financial regulators moved faster than the general AI regulatory framework. In 2024–2025, both SEBI and RBI issued guidance requiring regulated entities, banks, NBFCs, brokers, insurance companies, to:

  • Disclose use of AI in customer-facing products and credit decisions
  • Maintain human oversight for AI-assisted decisions with material consequences
  • Conduct periodic audits of algorithmic systems for bias and fairness
  • Ensure AI systems are explainable when questioned by customers or regulators

For Indian fintech companies and BFSI-sector AI deployments, this guidance creates actionable obligations today. Explainability is no longer just a design principle, it’s something auditors can ask for.

The EU AI Act’s Indirect Reach

The EU AI Act passed in 2024 and its requirements phase in through 2026. For many Indian businesses this looks like a foreign regulatory development. In practice, it is not:

  • Indian IT services companies, including many large and mid-tier players, deploy AI tools for European enterprise clients. High-risk AI applications under the Act (covering HR systems, credit scoring, biometric identification, and others) require conformity assessments and documentation that those Indian vendors are now expected to provide or support.
  • Indian SaaS companies with European customers selling AI-powered features must evaluate whether their product falls under the Act’s scope.
  • The Act’s prohibited categories (social scoring, real-time biometric surveillance in public spaces) are absolute prohibitions regardless of where the deploying organization is incorporated.

What Responsible AI Practice Looks Like in This Environment

Waiting for a comprehensive Indian AI law before building responsible AI practices is the wrong frame. The building blocks of responsible AI, documentation, bias testing, human oversight, data governance, transparency with users, are good practice regardless of regulation, and they reduce compliance retrofit costs when specific obligations arrive.

Practically, Indian organizations building or deploying AI should be doing at least the following:

  • Maintaining an inventory of AI systems and the personal data they process
  • Documenting the purpose, data sources, and decision logic for each system
  • Establishing a process for handling user requests about AI-driven decisions
  • Reviewing third-party AI provider data processing terms against DPDP principles
  • Monitoring sector-specific regulatory guidance from RBI, SEBI, IRDAI, and MeitY
